Now again in the name
of Multilevel Marketing, Network Marketing many companies like Amway, Gold
Quest, Tupperware and many companies are again leading Indians towards
Economic slavery. As usual history is
repeating. Some of our own brothers
and sisters have become traitors and have joined hands with these companies. v
Sensing this present
situation, our forefathers and Law makers had made our Indian fort strong by
enacting a powerful Act called ‘Prize
Chits and Money Circulation Schemes (Banning) Act, 1978’. v
This Act bans Money
Circulation Schemes as well as Multilevel Marketing, Network Marketing
schemes etc. v
This has been
reiterated by Hon’ble High Court of Madras, Reserve Bank of Prize Chits
and Money Circulation (Banning) Act, 1978 According to Sec.2(c) of the Act defines Money Circulation
Schemes as: “Any scheme, by whatever the name called, for making of quick or easy
money, or for the receipt of any money,
or valuable thing as the consideration for a
promise to pay money, on any event or
contingency relative or applicable to the
enrollment of members into the scheme, whether or not such money or thing is derived from the entrance money of the members of such scheme for periodical subscriptions”. Thus any scheme which involves enrollment and making of quick or
easy money is nothing but Money circulation schemes. v the court
held that the Multilevel Marketing scheme, by whatever attractive name it is
called, is illegal and that the Director General of Police and other law
enforcing authorities must have a watchful eye on all such activities and
take timely actions. v Secondly, the person concerned does not get the value of money he
pays. v Thirdly, the companies collect service charges on the sale of
goods. No service charge can be
collected while the goods are sold.
Apart from that, the MLM results in exploitation of personal influence
